Terms of Service

These Terms describe the agreement between Cashfin and the businesses that use Cashfin Business to run their operations and sell online. Please read them together with our Privacy Policy.

Acceptance of These Terms

These Terms of Service (the "Terms") govern your access to and use of the Cashfin Business platform, including the business dashboard, the storefront builder and any storefront published through it, mobile applications, APIs and related services (together, the "Services"), provided by Cashfin Africa ("Cashfin", "we", "us").

By creating an account, accessing or using the Services you agree to be bound by these Terms and by our Privacy Policy. If you use the Services on behalf of a business, you confirm that you are authorised to bind that business, and "you" refers to the business.

Eligibility and Accounts

You must be at least 18 years old and able to enter into a binding contract to use the Services. You are responsible for providing accurate registration details, for keeping your login credentials confidential and for all activity that occurs under your account, including activity by team members you invite.

We may ask you to verify your email address, phone number or business identity before enabling some features, and we may suspend accounts whose details we cannot verify.

The Services

The Services help businesses manage customers, quotes, invoices, orders, inventory, bookings, payments, accounting and marketing, and to publish a storefront on a Cashfin subdomain or a custom domain. Features vary by subscription plan and may change over time.

Some features rely on third parties, such as mobile money and card payment processors, email and messaging providers, and social media or design platforms you choose to connect. Their terms apply to your use of those integrations, and we are not responsible for their availability or conduct.

Your Obligations as a Merchant

You agree to:

  • use the Services only for lawful business purposes and in compliance with applicable laws, including consumer protection, tax, data protection and anti-money-laundering requirements;
  • provide your own customers with accurate product, pricing, delivery and refund information, and honour the terms you publish to them;
  • ensure you hold the rights to any content, images, trademarks or product data you upload or publish through a storefront;
  • keep records that your business is legally required to keep; the Services support but do not replace that obligation.

You are solely responsible for the goods and services you sell. A storefront published through Cashfin is your storefront, and any contract of sale is between you and your customer.

Payments, Subscriptions and Fees

Paid plans are billed in advance for the billing cycle you select and renew automatically until cancelled. Prices, plan limits and included features are shown at the point of purchase. Taxes may be added where required by law.

Payments collected from your customers are processed by the payment providers you have configured. Processor fees, settlement timing and chargeback or reversal rules are set by those providers and are disclosed when you connect them. Cashfin may charge transaction or service fees where stated in your plan.

You may cancel a subscription at any time; access continues until the end of the paid period. Fees already paid are non-refundable except where the law requires otherwise.

Content and Intellectual Property

You retain ownership of the data and content you upload. You grant Cashfin a licence to host, process, display and transmit that content only as needed to provide the Services to you and to your customers.

Cashfin and its licensors own the Services, including software, templates, designs and branding. Except for the limited right to use the Services under these Terms, no rights are granted to you. Where a plan allows removing Cashfin branding from your storefront, that setting applies only to your published storefront.

Data Protection

Our Privacy Policy explains how we handle personal data. For personal data about your customers that you enter into the Services, you are the controller and Cashfin processes it on your instructions to deliver the Services. You are responsible for having a lawful basis to collect that data and for responding to your customers' requests about it.

Prohibited Use

You must not use the Services to:

  • sell goods or services that are illegal or that we notify you are not permitted on the platform;
  • send unsolicited or deceptive messages, or infringe another person's rights;
  • interfere with, probe or circumvent the security or limits of the Services;
  • access another business's data or impersonate another person or business.

Suspension and Termination

You may close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law or a payment provider, if your account is unpaid, or to protect the Services or other users. Where reasonable we will give you notice and an opportunity to export your data first.

Disclaimers and Limitation of Liability

The Services are provided "as is". We do not guarantee that they will be uninterrupted or error-free, or that reports and analytics are a substitute for professional accounting, tax or legal advice.

To the extent permitted by law, Cashfin is not liable for indirect or consequential loss, loss of profit, revenue or data, or for losses caused by third-party providers or by your own customers. Our total liability for claims arising from the Services in any twelve-month period is limited to the fees you paid to Cashfin in that period. Nothing in these Terms limits liability that cannot be limited by law.

Changes to the Services or These Terms

We may update the Services and these Terms. For material changes we will notify you through the dashboard or by email before they take effect. Continued use after the effective date means you accept the updated Terms. The current version and its effective date are always shown on this page.

Governing Law and Contact

These Terms are governed by the laws of the Republic of Kenya, and disputes are subject to the jurisdiction of its courts, without prejudice to any mandatory consumer protections in your country.
